Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and DevelopingRiches Inc. (“DevelopingRiches,” “we,” “us”), which operates ReputationEmpirez and its products (the “Services”). By creating an account or using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you are authorized to bind it.

1. Who operates the Services (operator disclosure)

The Services are owned and operated by DevelopingRiches Inc., a California corporation. “Jim Silver” is a pen name (pseudonym) used publicly by Jim Harris, the owner of DevelopingRiches Inc. References to “Jim Silver” in marketing, founder messages, bylines, and customer communications refer to the same individual operating the business through DevelopingRiches Inc. This disclosure exists so customers always know the real legal entity they are contracting with. 2. Accounts

• You must provide accurate information and keep your credentials secure;
• You are responsible for activity under your account;
• You must be at least 18 and use the Services only for lawful business purposes.

3. Acceptable use

Your use is subject to our Acceptable Use Policy, which prohibits, among other things, generating fake or deceptive reviews, manipulating platforms in violation of their rules, harassment, and unlawful activity. Violations may result in suspension or termination.

4. Subscriptions, billing & taxes

• Paid plans are billed in advance on a recurring basis (monthly or as stated at checkout) and renew automatically until cancelled;
• You authorize us and our payment processor to charge your payment method;
• Fees are exclusive of taxes, which we may collect where required;
• You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current billing period.

5. Refunds

We offer a 30-day money-back guarantee on subscription fees: if you are not satisfied, contact us within 30 days of your initial subscription charge for a refund of that charge. One-time purchases (including add-ons and hardware such as NFC cards) are non-refundable except where required by law. Refunds apply to the initial subscription term and not to subsequent renewals. This refund policy is fixed by company policy; do not alter without owner approval.

6. Intellectual property

We and our licensors own the Services, including software, designs, and trademarks (ReputationEmpirez and product names). We grant you a limited, non-exclusive, non-transferable right to use the Services per these Terms. You retain ownership of content you submit (“Customer Content”) and grant us a license to host and process it to provide the Services. You are responsible for having the rights to any Customer Content you upload.

7. Third-party platforms

The Services interact with third-party review and communication platforms (e.g., Google, Yelp, Meta) subject to those platforms’ terms. We do not control and are not responsible for third-party platforms, and we do not promise removal of any content or any particular ranking or rating outcome.

8. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages; and our total liability arising out of or relating to the Services will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.

10. Indemnification

You will defend and indemnify DevelopingRiches against third-party claims arising from your Customer Content, your use of the Services in violation of these Terms or law, or your violation of a third party’s rights.

11. Suspension & termination

We may suspend or terminate access for violation of these Terms, non-payment, or to protect the Services or others. You may terminate by closing your account. Sections that by their nature should survive (IP, disclaimers, liability, indemnity, dispute terms) survive termination.

12. Dispute resolution; arbitration

We will first try to resolve disputes informally. 13. Governing law & venue

We may update these Terms; we will post the revised version and update the “Last updated” date, and provide notice of material changes as required. Continued use after changes take effect constitutes acceptance.
